  • Typically, the personal representative of the deceased’s estate must file the claim. Compensation is then distributed to eligible surviving family members. Stein Law helps families navigate this process with clarity and compassion.

  • Possible compensation includes funeral and burial expenses, medical bills, lost income and benefits, loss of companionship and loss of future financial support. The specific damages depend on the circumstances and the victim’s age and role in the family.

  • Indiana’s statute of limitations is generally two years from the date of death. In Kentucky, the statute of limitations could be as short as one year from the date of death.  However, investigating a wrongful death case takes time, especially those involving commercial vehicles, or disputed liability, so early legal involvement is critical.
