Civil Appeals
When a trial doesn’t feel fair, the story isn’t always over.
If you believe the court made a legal mistake in your case, a civil appeal may be your chance to seek a different outcome.
At Stein Law, our civil appeals team helps clients challenge unfair or legally flawed decisions in cases involving family law, personal injury, medical malpractice, probate, and other civil matters. Whether we handled your original case or you’re coming to us after working with a different lawyer, we can evaluate your options and guide you through the appellate process with clarity and honesty.
When it comes to law firms… bigger isn’t always better.
Appeals demand close reading, careful legal analysis, and strong written advocacy, not a high-volume, assembly-line approach.
What Is a Civil Appeal?
A civil appeal is not a new trial. You don’t call new witnesses or present new evidence. Instead, the appellate court reviews the record from your original case to decide whether the trial court:
Misapplied the law
Relied on evidence it shouldn’t have, or excluded evidence it should have heard
Abused its discretion in making certain decisions
Appeals are about legal error, not simply disagreeing with the outcome. Our job is to identify the strongest appealable issues, explain them clearly to the court, and advocate for a fair result under the law.
Made errors that likely affected the result
Cases We Handle on Appeal
Stein Law handles a range of civil appeals in Southern Indiana and the greater Louisville region, including:
Family Law Appeals
Custody, parenting time, child support, property division, and other orders where the court may have misapplied the law or weighed evidence improperly.
Personal Injury & Medical Malpractice Appeals
Verdicts or rulings involving liability, damages, admissibility of evidence, or legal standards in serious injury and malpractice matters.
Probate & Estate Appeals
Will interpretation, fiduciary issues, and contested probate decisions.
Other Civil Appeals
Contract disputes, protective orders, and other civil judgments where a legal error may have changed the outcome.
We can step in even if Stein Law did not handle your original trial. Many clients come to us specifically for appellate representation after working with another firm.
How Our Civil Appeals Team Helps
Honest Case Evaluation
We begin by reviewing your orders, key pleadings, and (when available) portions of the transcript. We’ll tell you:
Whether the issues in your case are likely to succeed on appeal
What the potential outcomes are (affirm, reverse, remand, modify)
What the process, timing, and cost are likely to look like
If an appeal isn’t in your best interest, we’ll say so.
Identifying Appealable Issues
Strong appeals are focused, not scattered. We look for:
Clear misapplications of statutes or case law
Errors in admitting or excluding evidence
Procedural mistakes that affected your rights
Abuses of discretion in areas like custody, support, or property division
Then we narrow to the issues most likely to resonate with the appellate court.
Building the Record & Writing the Briefs
Appeals are won and lost on the written word. We:
Obtain and review the trial transcripts and exhibits
Research supporting statutes and case law
Draft persuasive, well-structured appellate briefs
Respond to the other side’s arguments in a clear, disciplined way
Our attorneys are known for thorough research and precise legal writing, both essential in appellate work.
Oral Argument (When Required)
If the appellate court schedules oral argument, we:
Prepare you for what to expect
Refine key themes and responses to likely questions
Present focused, respectful argument to the judges
The goal is not to re-try your case, but to clarify why the trial court’s decision cannot stand under the law.
Why Choose Stein Law for Civil Appeals?
Appellate Experience You Can Trust
Stein Law has handled appeals in family law, injury, malpractice, and other civil matters, including cases where our attorneys have presented oral argument before Indiana’s appellate courts. We’re comfortable in the appellate environment and understand what these courts expect.
Detail-Driven and Research-Focused
Appeals demand a different skill set than trial work. Our appellate lawyers are known for:
Careful review of the record
Strong, well-supported legal analysis
Clear, concise writing that respects the court’s time
Straightforward Guidance in a Challenging Season
By the time clients reach us for an appeal, they’re often exhausted by the trial process. We take the time to:
Explain your options in plain language
Set realistic expectations
Keep you informed as your appeal moves forward
Timing Matters in Appeals
Civil appeals must be filed within strict deadlines, often measured in days, not months, from the date of the final order or judgment. If you think something went wrong in your case:
Do not wait for “things to settle down”.
Do not assume you have plenty of time.
Reaching out early gives us the best chance to protect your right to appeal.
Civil Appeals FAQs
-
No. An appeal must be based on legal error, not just disagreement with the result. We look for mistakes in how the law was applied or how the court handled procedure or evidence, then advise you whether those errors are strong enough to raise on appeal.
-
The only way to know is through a careful review of your orders and the record. In an initial consultation, we’ll discuss what happened in your case, look at key documents, and tell you whether an appeal appears viable and what the possible outcomes might be.
-
Yes. Stein Law frequently steps in specifically as appellate counsel after another lawyer handled the trial. We evaluate the record fresh, identify potential issues, and work with you to decide whether moving forward with an appeal makes sense.
